Licenses and Agreements: Responding to Potential Pitfalls

Abstract:

Information systems and computer science students need to be exposed to a variety of system and applications software and fortunately many software vendors offer academic pricing and programs which facilitate access; however, associated licensing and membership agreements can require substantial concessions that conflict with institutional policy. Clauses concerning independent contractor, indemnity and place of jurisdiction as well as who holds institutional signature authority pose considerable potential problems. This is especially true for state-supported schools. This paper will examine the meaning of these clauses and risks they pose. A survey of academic software licenses and agreements will reveal the degree of pervasiveness of these clauses. Finally, various responses to the risks will be considered.
Kerry L. Henson is an Assistant Professor of Computer Information Systems at the University of Central Missouri. He obtained an MBA and PhD in information systems from the University of North Texas. He teaches a variety of courses including networking, COBOL and interaction design while his research interests focus upon pedegological issues and interaction design.
